1. Introduction

1.1 Agreement Overview

Welcome to Career Compass. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CodeTech (NIP: 7631936648) ("Career Compass," "we," "us," or "our").

Career Compass is a career intelligence platform that helps professionals understand their career strengths through resume scoring, job matching, and market insights.

1.2 Acceptance of Terms

By creating an account, accessing, or using Career Compass, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

Your acceptance is confirmed when you:

  • Check the "I agree to the Terms of Service" checkbox during registration
  • Log in to an existing account
  • Continue using the Service after being notified of updated Terms

1.3 Eligibility

You must be at least 18 years of age to use Career Compass. By using our Service, you represent that you meet this age requirement.

2. Definitions

For the purposes of these Terms:

3. Account Registration

3.1 Account Creation

To use Career Compass, you must create an account by:

  • Providing a valid email address and creating a password, OR
  • Authenticating through Google OAuth

3.2 Account Requirements

You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account information updated
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account

3.3 One Account Per Person

Each individual may maintain only one Career Compass account. Creating multiple accounts may result in termination of all accounts.

3.4 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Service Description

Career Compass provides the following features:

4.1 Resume Scoring

We analyze your uploaded resume using our Three Pillars Model:

  • Experience Pillar: Evaluates role clarity, career depth, industry breadth, and achievement impact
  • Competencies Pillar: Assesses certifications, technical skills, soft skills, and tools/methodologies
  • Presentation Pillar: Reviews contact completeness, content structure, data quality, and language proficiency

Scores range from 0-100, with quality levels from Incomplete to Excellent.

4.2 Job Matching

When you provide a job posting URL, we:

  • Extract job requirements using AI
  • Compare your profile against the job requirements
  • Calculate match scores for Role Fit, Skills Fit, and Preferences Fit
  • Provide insights on strengths and gaps

4.3 Keyword Coverage Analysis

We analyze how your resume keywords align with expected keywords for your target roles.

4.4 Career Insights

We provide automated analysis of your CV strengths and areas for improvement based on our scoring algorithms.

4.5 AI Content Generation

Career Compass offers AI-powered content generation features, including:

  • Cover Letters: Tailored cover letters generated for specific job postings
  • Elevator Pitches: Concise professional summaries for networking and introductions
  • Interview Preparation: Role-specific questions and tips to help you prepare
  • Achievement Enhancement: Suggestions to improve how you present your accomplishments
  • Certification and Training Recommendations: Personalized suggestions based on your career goals
  • Market Intelligence: Community trending data and market insights for your field

All AI-generated content is provided as a starting point. You are responsible for reviewing, editing, and verifying any content before use.

4.6 AI Action System and Paid Services

Career Compass uses an AI action-based credit system for AI-powered features:

  • Free tier: Each account receives 10 AI actions per month and a one-time welcome bonus of 10 AI actions upon registration
  • Purchased AI actions: Additional AI action packs can be purchased through the app via Stripe. All prices are displayed at the time of purchase
  • AI action expiration: Monthly free AI actions expire at the end of each calendar month. Purchased AI action packs have their own validity period as specified at the time of purchase
  • EU withdrawal right: Under EU consumer protection law, you have the right to withdraw from a purchase within 14 days. However, by purchasing AI action tokens and initiating their use, you expressly consent to the immediate provision of the digital service and acknowledge that you lose your right of withdrawal once tokens have been consumed. For refund requests regarding unused tokens, please contact support@careercompass.pl

4.7 Right of Withdrawal

Under EU Directive 2011/83/EU, you have a 14-day cooling-off period for digital content purchases. However, you may waive this right under the following conditions:

  • You expressly consent to the immediate performance of the digital service upon purchase
  • You acknowledge that you lose your right of withdrawal once the digital content (AI action tokens) has been consumed

To exercise your right of withdrawal, contact us at support@careercompass.pl within 14 days of your purchase. Consumed tokens are non-refundable after consent to begin performance. Unused tokens from the same purchase may be refunded upon a valid withdrawal request.

4.8 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

5. User Responsibilities

5.1 Accurate Information

You agree to:

  • Upload only your own, authentic resume
  • Provide truthful and accurate professional information
  • Not misrepresent your qualifications, experience, or credentials

5.2 Content Rights

You represent and warrant that:

  • You own or have the right to upload all content you submit
  • Your content does not infringe any third-party intellectual property rights
  • Your content does not violate any applicable laws

5.3 Credential Security

You agree to:

  • Keep your password secure and confidential
  • Not share your account credentials with others
  • Log out from shared or public devices

5.4 Personal Use Only

Career Compass accounts are for individual, personal use only. Commercial use, resale, or providing access to others is prohibited without our written consent.

5.5 Compliance with Laws

You agree to use the Service in compliance with all applicable laws and regulations, including GDPR and other data protection laws.

6. User Content

6.1 Your Ownership

You retain all ownership rights to your User Content, including your resume and professional information. We do not claim ownership of your content.

6.2 License Grant

By uploading content to Career Compass, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Store your content on our servers
  • Process your content for AI extraction and analysis
  • Display your content back to you within the Service
  • Create derivative data (scores, insights) from your content

6.3 License Limitations

This license is:

  • Limited to providing and improving the Service
  • Terminated when you delete your content or account
  • Not a transfer of ownership

6.4 Content Deletion

When you delete your account:

  • Your User Content, including resume files, is deleted immediately
  • Aggregated, non-personal statistical data (such as average scores by role category, skill frequency distributions) that cannot be linked back to individual users may be retained for service improvement
  • A SHA-256 hashed audit record of your email address is retained for 3 years for GDPR compliance documentation

7. Prohibited Activities

You agree NOT to:

7.1 Content Violations

  • Upload false, misleading, or fraudulent information
  • Upload content belonging to another person without authorization
  • Upload malicious files or code

7.2 Platform Abuse

  • Scrape, crawl, or automatically extract data from the Service
  • Attempt to reverse-engineer our algorithms or scoring models
  • Circumvent security measures or access controls
  • Interfere with the proper functioning of the Service

7.3 Commercial Misuse

  • Resell, redistribute, or commercially exploit the Service
  • Use the Service to provide competing services
  • Share account access with others for commercial purposes

7.4 Harmful Behavior

  • Harass, abuse, or harm other users or our staff
  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations

7.5 Consequences

Violation of these prohibitions may result in immediate account termination without notice or refund.

8. Intellectual Property

8.1 Our Intellectual Property

Career Compass and CodeTech own all rights to:

  • The Platform, including software, code, and infrastructure
  • The Three Pillars Model scoring algorithms and methodology
  • All trademarks, logos, and branding elements
  • Documentation, tutorials, and help content
  • Aggregated insights derived from anonymized user data

8.2 Restrictions

You may not:

  • Copy, modify, or create derivative works of our Platform
  • Reverse-engineer, decompile, or disassemble our software
  • Use our trademarks without written permission
  • Claim ownership of our intellectual property

8.3 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without compensation or attribution to you.

9. Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Career Compass, you acknowledge the data practices described in our Privacy Policy. Core AI-powered features (resume scoring, job matching, AI content generation) operate under the contractual basis described in Section 4 of the Privacy Policy.

10. Disclaimer of Warranties

10.1 "As Is" Service

Career Compass is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

10.2 No Guarantees

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Profile scores or job match results will lead to employment
  • AI extraction will be 100% accurate
  • Job posting information will be current or accurate

10.3 Algorithmic Assessment Disclaimer

Important: Our resume scoring and job matching features provide guidance only. They are algorithmic assessments based on our methodology and should not be considered:

  • Professional career advice
  • Guarantees of job placement or interview success
  • Absolute measures of your professional worth

10.4 Third-Party Content

We are not responsible for the accuracy, completeness, or reliability of:

  • Job postings from external websites
  • Information extracted from third-party sources
  • Content provided by other users

10.5 Warranty Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, including:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

11. Limitation of Liability

11.1 Liability Cap

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service is limited to:

  • The amount you paid us in the 12 months preceding the claim, OR
  • €100, whichever is greater

11.2 Exclusion of Damages

We are not liable for any:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, revenue, or business opportunities
  • Loss of data or goodwill
  • Damages resulting from unauthorized access to your account
  • Damages from third-party job postings or external websites

11.3 Third-Party Responsibility

We are not responsible for:

  • Actions or omissions of employers or recruiters
  • Decisions made based on our scoring or matching results
  • Accuracy of job postings from external sources

11.4 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose.

11.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under EU law, which cannot be waived by contract.

12. Indemnification

12.1 Your Indemnification Obligation

To the extent permitted by applicable law, and except where prohibited by mandatory consumer protection legislation in your jurisdiction, you agree to indemnify, defend, and hold harmless Career Compass, CodeTech, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights
  • Your misuse of the Service
  • Your violation of any applicable laws

12.2 Cooperation

We will notify you promptly of any claim subject to indemnification. You agree to cooperate in the defense of such claims.

13. Termination

13.1 Your Right to Terminate

You may terminate your account at any time by:

We may suspend or terminate your account if:

  • You violate these Terms
  • We are required to do so by law
  • We discontinue the Service
  • We reasonably believe your account poses a security risk

13.3 Effect of Termination

Upon termination:

  • Your right to access the Service ends immediately
  • Your User Content will be deleted according to our retention policy
  • Provisions that should survive termination (indemnification, limitation of liability, governing law) will remain in effect

13.4 No Refund on Termination for Cause

If we terminate your account for violation of these Terms, you are not entitled to any refund of fees paid.

14. Governing Law

14.1 Applicable Law

These Terms are governed by the laws of the Republic of Poland, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Wroclaw, Poland.

14.3 EU Consumer Rights

If you are a consumer habitually resident in an EU Member State, you benefit from the mandatory provisions of the consumer protection laws of your Member State, which cannot be overridden by these Terms regardless of the governing law clause. Nothing in these Terms restricts any rights you have under applicable consumer protection legislation, including the EU Consumer Rights Directive (2011/83/EU).

14.4 Language

These Terms are drafted in English. In case of any translation, the English version shall prevail.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at support@careercompass.pl to attempt informal resolution. We will respond within 30 days.

15.2 Mediation

If informal resolution fails, either party may propose mediation before a mutually agreed mediator.

15.3 Legal Proceedings

If mediation fails or is rejected, disputes may be resolved through the courts specified in Section 14.

15.4 EU Online Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

16. Changes to Terms

16.1 Our Right to Modify

We may modify these Terms at any time. Changes become effective when posted unless otherwise specified.

16.2 Notification of Changes

For material changes, we will:

  • Post the updated Terms with a new "Last Updated" date
  • Notify you by email at least 14 days before changes take effect
  • Clearly indicate what has changed

16.3 Your Options

After notification of material changes:

  • Accept: Continue using the Service after the effective date
  • Reject: Delete your account before the effective date

Continued use after the effective date constitutes acceptance of the updated Terms.

16.4 Non-Material Changes

Minor changes (typos, clarifications that don't affect your rights) may be made without advance notice.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Career Compass regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

Headings

Section headings are for convenience only and do not affect interpretation.

By using Career Compass, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
